Your rights as a casual worker in Australia — what you need to know

Casual doesn't mean unprotected. Here's a clear breakdown of your workplace rights under the Fair Work Act.

Many casual workers in Australia don't fully understand their rights in the workplace. Knowing what you're entitled to can make a real difference to your working life and finances.

The casual loading

As a casual worker you're entitled to a casual loading of at least 25% on top of the permanent pay rate for your role. This loading compensates for the lack of paid leave entitlements.

National Employment Standards for casuals

Under the Fair Work Act 2009, casual employees are entitled to unpaid carer's leave, compassionate leave, family and domestic violence leave, community service leave, and long service leave after the qualifying period.

Superannuation

Your employer must pay the Superannuation Guarantee (currently 11%) into your nominated super fund. This applies to casual workers the same as permanent employees.

The right to convert to permanent

After 12 months of regular casual employment, you have the right to request conversion to permanent employment. Your employer can only refuse on reasonable business grounds.

Workplace safety

All workers, regardless of employment type, have the right to a safe workplace. You have the right to refuse unsafe work.
